How to end your flatshare tenancy early, after May 1st 2026 (England)

From 1 May 2026, the Renters' Rights Act will come into effect in England. Keep reading to see how this will affect ending your flatshare tenancy.

What happens when the Renters' Rights Act comes into effect?

Prior to 1 May 2026, if you lived in a flatshare, you likely had a contract called an Assured Shorthold Tenancy (AST). These typically looked like one of two agreements:

  • Shared AST - You rent the property as a group and all sign a joint contract with the landlord.
  • By the room AST - Each of you has your own individual agreement with the landlord.

An Assured Shorthold Tenancy includes a 'fixed term' which normally lasts for 6 months (but could be as long as 3 years), meaning you couldn't easily end your tenancy during this period.

As of 1 May 2026, all fixed term tenancies will be abolished and existing contracts will automatically convert to rolling tenancies under the Renters' Rights Act.

What does this mean if I want to end my tenancy early?

A rolling tenancy means the agreement is open-ended with no set end date. From 1 May 2026, tenants can leave by giving two months' written notice.

Lodger agreements

If you're living as a lodger in someone's home, things are much less formally set out. In this case you should be able to discuss your need to leave with your landlord and come to a mutual arrangement.

Giving notice

Even if you're coming to the end of a contract period you should still give written notice. This can be a simple letter to the landlord stating that you wish to move out on a certain date. The landlord should then get in touch to discuss the arrangements and the return of your deposit.

Getting a replacement tenant

You may be able to agree with the landlord that you'll find a replacement flatmate. Many rooms are advertised on SpareRoom by previous flatmates looking for a replacement so that they can move out. The landlord (and other flatmates) will want to be able to vet the new tenant.
